Is Kratom Legal In Pennsylvania State?

Kratom bans aren’t common. In fact, there are a bunch of states that have banned kratom, including Vermont, Alabama, Indiana, and Rhode Island. Fortunately, that is not the case with the Commonwealth of Pennsylvania. There hadn’t been a complete ban on kratom in this state even in history. But kratom is legal in Pennsylvania.

However, this doesn’t mean that people in the state don’t see it as a controversial substance. To balance the odds, hundreds and thousands of consumers currently support kratom’s consumption in the state.

Kratom is legal in Pennsylvania, and much like any other state that legalizes it, it allows its residents to freely buy, sell and consume kratom. It is fairly popular and readily available locally, but the majority of consumers still prefer to buy it online.

Current And Pending Legislation Regarding Kratom In Pennsylvania

Though there have been several efforts to classify or restrict the use of this South Asian herb, kratom is legal and openly available in the state. It dates back to 2019 when a group of individuals tried to convince the FDA to ban kratom in the state altogether. Their individual efforts, though of meager importance, forced the FDA to look into this matter.

The same year several Democrats and Republicans sponsored a bill. The bill’s main purpose was to draw the United States Food and Drug Administration’s attention to the importance of regulating kratom in Pennsylvania.

The bill reflected a community of members who were unsure of the kratom’s safety and asked for a clear guideline for the use of kratom.

The bill wasn’t presented even for voting and the house dismissed it from the dice. The reason for its removal was clear and valid.

According to the federal government, if any community wanted some regulations and guidelines, they should do it themselves rather than relying on the federal sectors.

Another incident relating to kratom came forward when a couple, parents of 25-year old Caleb Sturgis, tried to ban kratom by blaming their son’s death on kratom. Caleb Sturgis was driving when he got a heart attack and died.

His parents said that his heart attack was due to kratom consumption and sued the kratom company SoCal Herbal Remedies, from which he used to buy kratom.

The case was looked upon by a number of kratom enthusiasts, journalists, and kratom specialists. A famous HuffPost journalist Nick Wing who looked deeply into the matter repeatedly asked the coroner’s office to provide detailed autopsy and toxicology test results.

They did not provide the reports even on repeated requests. According to him, there is not much possibility of any link between kratom and heart attack, let alone death on its own. Nick tweeted that

“As a reminder: Coroners around the country are blaming kratom for deaths, even though science suggests it’s very unlikely — perhaps impossible — for kratom to kill on its own. Those disputed determinations are then being used to push a ban on the herbal supplement. 7/”

“And when people like me try to make sure coroners/medical examiners aren’t being negligent in their findings, some of those public officials are maintaining that we have no right to check their work. 8/”

Nick was still looking for leads when another kratom enthusiast provided an important link to the true story. He tweeted the screenshots from Sturgis’s posts on Facebook about kratom usage.

In these posts, Sturgis shared his experience on kratom, and he was all positive and wanted to order a huge shipment because he never wanted kratom to run out. But this is not all. He admitted that he was not addicted to kratom, and he also used to take tianeptine and took.

Another important thing he mentioned was kava. The screenshots also explained how he clearly overdosed kava and was feeling weird, and was even unable to stand. He also mentioned that overdosing kava is way worse than kratom.

Tianeptine is a selective serotonin reuptake inhibitor used in France and is an antidepressant. Its overdose is often linked to cardiovascular disorders, including heart attack.

To date, there is no legislation to ban kratom; however, a petition requesting the state to implement the Kratom Consumer Protection Act exists. This whole story clears the misconception that kratom was the primary cause of death for Sturgis.

Has Pennsylvania State Adopted The Kratom Consumer Protection Act?

The Kratom Consumer Protection Act is a set of regulations that aim to make kratom safe for consumers. It defines the safety limits and necessary precautions so that kratom’s legal status stays preserved.

The Act is pushed by the American Kratom Association in every state in the hope of giving a safer option towards legalizing kratom rather than banning and fearing it.

The main aim behind its spread is to ensure unadulterated and fully tested products reach mainstream consumers. Kratom Consumer Protection Act is state-specific and is thus sensitive to kratom legality in every state.

It is because the American Kratom Association in each state modifies the guidelines in the general public’s best interest.

The core components of the Act include registering the products and the vendors, labeling the products with expiries and ingredients, setting age restrictions for safe consumption, and setting quality and formulation standards.

Pennsylvania has not yet passed Kratom Consumer Protection Act. Still, it is positive about it, and consumers can expect its adoption any time soon.
