Is Kratom Legal In Nebraska?

The good news is – Yes. Nebraska is one of the many states where it is legal to use, sell and possess the supplement. In addition, Kratom is welcome for use all through the state. These include the major cities like Omaha, Lincoln, Grand Island, Kearney, Norfolk, and Bellevue.

Exploring Nebraska’s Kratom Legislation 

Unlike the other states where Kratom’s legality is under attack, the state of Nebraska has wholeheartedly accepted Kratom. As things stand, there’s little to no cause for concern. 

Looking back, the only legal issue that kratom has faced when it comes to legalities in Nebraska is the talk of the Drug Enforcement Administration banning this herb back in 2016. This is because as a federal agency, any ban passed by the agency would have been a nationwide ban. This would affect Kratom across all 50 states. If the bill had passed, it would have caused kratom to become part of the Schedule I list among other controlled substances.

Thankfully, the Kratom community was able to mobilize swiftly. It was able to generate an overwhelming amount of support for kratom. At the time, more than 140,000 people signed a petition to help overturn the DEA’s attempt to schedule kratom. And as soon as the agency realized they did not stand a chance, they withdrew their attempt to schedule this herb.

Beyond this nationwide talk of banning kratom, there have been no other attempts to either regulate or ban the supplement.  Kratom is popular for use widely in Nebraska and is available in numerous local smoke and vape shops.

Classification of Kratom In Nebraska

With Kratom’s legal status in Nebraska in mind, let’s consider the classification of the supplement within the state. As it stands, Kratom is not classified within the state and there has been no activity to indicate that happening any time soon. Unlike other states who are looking to either schedule or misrepresent the supplement, Nebraska has done a good job of remaining neutral and allowing its citizens to choose whether or not to use Kratom. 

What Next?

As it stands, the American Kratom Association alongside numerous Kratom vendors and partners are working tirelessly to get all 50 states to adopt the Kratom Consumer Protection Act. This act not only protects users’ right to Kratom, but it will also help regulate the industry, ensure quality control standards are met across all vendors hence making Kratom safer for users, and will inadvertently ease the issues lawmakers might have about the supplement. For Nebraska, adopting the KCPA would mean standardizing operational requirements for vendors and safeguarding the safety of their residents.
