Is Kratom Legal In Ohio?

Kratom status within the United State varies per state. Kratom is legal and readily available for immediate pickup and use in Ohio. This includes the major cities like Cleveland, Dayton, Akron, Columbus, and Cincinnati. 


Kratom Legislation In Ohio

At the moment, Kratom is legal in the state. There is no regulation because it is not among the states that have passed the Kratom Consumer Protection Act – more on this later. However, it is illegal to sell Kratom in any other form besides powder. It is also not possible to market Kratom is safe for human consumption since it hadn’t been classified as such by the FDA.

And in case you thought this could be one of the laws that the authorities did not deem as important, in 2019, the state raided 10 stores for selling Kratom edibles and marketing Kratom is safe for human consumption. Within all 50 states, it is currently illegal to market the supplement as a cure for opioid addiction or other medical conditions. 

Kratom also came under attack in March 2019. The state’s board of pharmacy voted to classify the supplement as a Schedule 1 substance. Drugs within this classification are ones that have no medical value and have a high likelihood for abuse. By putting Kratom here, they were placing it alongside other substances like marijuana, heroin, LSD, ecstasy, and magic mushrooms.

Next Steps

A few days after their vote was made public, the AKA (American Kratom Association) began rallying support within the community. They wanted to get the board to rescind its decision. The Virginia-based kratom advocacy group was successful. Thousands of people emailed the board to give positive remarks about the supplement during the public comment period. Over 90 people gave their testimonies. This overwhelming support got the proposed scheduling to be delayed in August of the same year. 

Within that same time frame, state representative, Rep. Gary Scherer filed a bill to legalize and regulate the supplement. Fortunately, the bill has not received any traction since its initial filing. There hasn’t been any renewal of efforts towards re-scheduling Kratom since the initial delay period. 

Reviewing Kratom’s Classification in Ohio

Understanding the classification of Kratom in your state is very important. Kratom can be legal in your state yet be classified incorrectly causing there to be silent restrictions on it that you may not be aware of. The Buckeye state does sometimes have a lot of negative press on kratom. This has led many state officials to attempt to ban the supplement in the past. At this time, Kratom is legal and unclassified. The only restrictions are the ones from before- the form in which one can sell kratom.

And until the Kratom Consumer Protection Act is in place, there will always be a possibility that kratom could be banned.

We are also hoping that Federal and statewide kratom bans will become a thing of the past as all kratom users use and enjoy their favorite supplement without fear of government persecution.
