The kratom Enthusiasts, on the other hand, wanted to accept nothing else but the Kratom Consumer Protection Act. Around June, kratom was left out of the bill. The major reason behind its failure was that lawmakers were unconvinced to find the necessary time to design and uphold such regulations.

Another effort to regulate kratom in Oregon was made in 2020 in the shape of a bill that again met the same fate and failed. Finally, in January 2021, another bill sponsored by a substantial number of state representatives (11 Republicans and 4 Democrats was successfully passed.

What Are The Effects And Consequences Of Passing The Kratom Consumer Protection Act?

The Kratom Consumer Protection Act, if applied in full swing, would have the following effects and consequences:

  • It will ban kratom that contains toxic, hazardous, or illicit substances.
  • It will forbid access to adulterated or kratom that contains other substances. It may affect the potency of alkaloids and compounds naturally present in kratom.
  • It will prohibit the distribution of the herb that contains more than 2% 7-hydroxy mitragynine.
  • It will prohibit selling any kratom products that contain synthetic kratom alkaloids.
  • It will require kratom merchants, manufacturers, and distributors to label all kratom products mentioning the concentration alkaloids and the dose suggestions.
  • It will ban selling kratom to persons under the age of 21.
  • It will fine up to $500 for the first offense and up to $1,000 for any subsequent offense violating the law.
  • It will also require classifying selling the herb to those under 21 as a Class C misdemeanor. In case of non-compliance, the guilty will be punished with 30 days of jail time, a fine worth $1,250, or both.

Although passed by the Senate, this house bill was vetoed by the Governor, and that is why Oregon is still struggling to regulate the sales, consumption, purchase, and production of kratom. The major reason behind vetoing was the Governor considers the Federal government (the FDA) is more suitable to regulate this natural herb.

Will Oregon Ban Kratom In The Future?

Currently, kratom is not a classified substance. But this might be true to say there have been many efforts to classify it as a control substance. Thanks to the American Kratom Association and its supporters that this South Asian herb is still breathing without the shackles of restrictions upon its use and sales. So Kratom is legal in Oregon.
