Is it possible to see open signboards reading “kratom for sale” or “Get your best kratom tea in Oregon here”? A big yes! It is because kratom is completely legal in Oregon. However, kratom’s journey in terms of legality in Oregon has been very bouncy.
Many attempts were lodged against this so-called-magical herb to ban it once and for all. On the other side, its enthusiasts and aficionados have been ever active to preserve its legal status.
The current news and call from state professionals show that Oregon looks more interested in regulating the herb than altogether banning it. Fortunately, it seems like a win-win situation for both sides. Let’s dig a little deeper into kratom legality in Oregon.
In 2017 the Food and Drug Association tried to ban kratom on the federal level. Various states resisted against their will, and inter-state pro-kratom movements were carried out. Oregon was one of the many pro-kratom states. Nonetheless, a bill (Senate Bill 518) was presented to classify kratom as a controlled substance.
Under the bill, the State Board of Pharmacy was directed to carry out a study to determine whether the plant mitragyna speciosa and its derivatives should be scheduled as a controlled substance. The bill took many kratom enthusiasts by surprise and worry. In the end, however, the bill failed to gather majority votes and was declared dead.

The injuries from the bill were still afresh when the salmonella outbreak involving kratom surfaced. The news occurred around February 2018, and two people were reported to be affected by kratom strains containing salmonella species in Oregon. Though both the patients recovered, the kratom-salmonella issue became the talk of the town.
This led to professionals issuing statements and suggestions to stop using this herb. This negative propaganda once again shifted FDA’s glares toward kratom. Worsening the situation, another 6 people became involved in the epidemic.
FDA believed that since the number of people being infected with kratom-related salmonella is high in Oregon, it has something to do with the retailers selling kratom here. The outbreak affected 41 states and involved around 199 people; 13 were from Oregon.
Several studies were conducted to find the link between kratom and salmonella species but in vain. Though many strains were identified as having salmonella, there was no common source. So, the culprit could not be identified, and kratom came out of this situation white-handed.
Nevertheless, one thing that was stressed this entire time was that impure kratom can be potentially harmful and that consumers should be very careful when buying kratom. It also sheds light on the role of inconsistent and bad vendors that may be selling adulterated products. In fact, these vendors were thought to be the major reason behind this outbreak.

The kratom Enthusiasts, on the other hand, wanted to accept nothing else but the Kratom Consumer Protection Act. Around June, kratom was left out of the bill. The major reason behind its failure was that lawmakers were unconvinced to find the necessary time to design and uphold such regulations.
Another effort to regulate kratom in Oregon was made in 2020 in the shape of a bill that again met the same fate and failed. Finally, in January 2021, another bill sponsored by a substantial number of state representatives (11 Republicans and 4 Democrats was successfully passed.

Although passed by the Senate, this house bill was vetoed by the Governor, and that is why Oregon is still struggling to regulate the sales, consumption, purchase, and production of kratom. The major reason behind vetoing was the Governor considers the Federal government (the FDA) is more suitable to regulate this natural herb.
Currently, kratom is not a classified substance. But this might be true to say there have been many efforts to classify it as a control substance. Thanks to the American Kratom Association and its supporters that this South Asian herb is still breathing without the shackles of restrictions upon its use and sales. So Kratom is legal in Oregon.
