Till date, there have been two petitions within Alabama. The petitions urge lawmakers to repeal their decision to place a ban on Kratom in 2016 and another calling for an appeal in 2017. Neither was successful and Kratom remains illegal till today.

At the time of this article, there has not been any strong movement on Kratom within the state. The last time Kratom did make headlines in the state however was in 2018. That’s when salmonella was reportedly found within Kratom across 41 states with the FDA confirming 2 of those cases occurred within Alaska.
According the report by the FDA, the outbreak took place between the beginning of 2017 and through the first half of 2018. One of the affected users was discovered to have bought their Kratom online. Another bought it from a store within the city of Anchorage. Both cases were isolated and the affected vendors were sanctioned by the government.

Save for the isolated contamination case in Alaska, there has been no negative reports involving Kratom purchases in Alaska. However, finding Kratom to buy within the state is not always a walk in the park. Most users have to order their supplement from online Kratom stores.

The good news is, Kratom is currently legal in Arizona. Although there was an intent to ban the natural supplement in 2014, it ended up being left out of the bill. The state went on to pass the Kratom Customer Protection Act aimed at regulating the supplement within state lines.
According to the 2014 bill, the intended substances were mitragynine and 7-hydromitragynine were to be termed as synthetic substances. This was false seeing as the entirety of Kratom’s composition is natural without any synthetic and harmful additions.

- Must not sell any contaminated kratom products or any products mixed with non-kratom substances that could be dangerous or alter the efficacy of Kratom.
- Must not sell kratom products mixed or laced with scheduled, dangerous or poisonous substances
- Abstain from selling Kratom products containing synthetic Kratom alkaloids or other Kratom compounds
- Must not sell any products that contain a high dose of 7-hydromitragynine content above a 2% total alkaloid content
- Provide labels that reveal the content of the mitragynine and 7-hydroxymitragynine present within the products.
- Must only sell Kratom products to customers over the age of 18
If any vendor flouts any of these laws, they could be guilty of a class 2 misdemeanor which is punishable with up to four months of jail or fine of no more than $750 in the case of violating the Arizona Kratom Consumer Protection Act.
In February 2021, a representative introduced a new bill aimed at amending the Arizona Kratom Consumer Protection Act. Within the bill were the following amendments.
- The replacement of the world “dealer” previously used within the act to refer to vendors, distributors, processors with the word “retailer”
- The prohibition of financial institutions like banks and credit card professors from terminating the accounts of Kratom vendors.
- Prohibition of state agencies from being able to take enforcement action like seizing Kratom products

At the moment, Kratom is illegal in the state of Arkansas. In 2015, the government decided to amend its list of controlled substances. They included Kratom amongst its list of Schedule 1 drugs. This move meant all vendors in Kratom were unable to sell the substances, online vendors are unable to ship it into the state and residents aren’t allowed to buy, use or distribute it within the state.
Residents and vendors who flout these laws face the risk of a Felony charge:
- Kratom possession can get one up to 20 years in jail or up to $15,000 in fines
- Being charged with Kratom possession of 2 grams of kratom or more within 1000 feet of parks, schools, colleges, places of worship, and more could also land one an additional 10 yeas in jail.
Exploring Arkansas’s Kratom laws
The current Kratom law in the state of Arkansas is from October 2015. The Arkansas Senate opted to include Kratom within its controlled substances list under Schedule I drugs. They amended the previous bill and added Kratom’s main alkaloids mitragynine and 7-hydromitragynine as “Opium Derivatives” alongside heroin, morphine and codeine.
This move was taken after a whistleblower informed the State’s Department of Health that Kratom showed opioid like effects after use. This was the trigger for the department’s reason to ban the substance. They deemed it to not be of any medical use per the FDA’s standards. The senate also deemed mitragynine and 7-hydromitragynine as synthetic.
There are however, glaring errors within the senate’s decisions to term Kratom as illegal. To begin with, mitragynine and 7-hydromitragynine are not opioid derivatives. They are actually kratom alkaloids making them kratom derivatives. Opium derivatives are from poppy while kratom is a plant from the Rubiaceae family (coffee). They are not the same plant together in any way.
The second error is that although Kratom affects the brain’s opioid receptors, the way it operates varies greatly from the way opioids interact with the brain. Kratom does not manage to produce the negative effects produced by opioids like respiratory depression amongst others. This classified Kratom is a partial opioid agonist unlike heroin or morphine which are full opioid agonists. As a partial opioid agonist, Kratom brings together the properties of opioid agonist and opioid antagonist making it a different plant.

Is Kratom Legal in California?

At the moment, Kratom use and sale is legal everywhere in California with the sole exception of the city of San Diego. San Diego’s ban on the natural supplement came in 2016. The city decided to put an end to the use, sale and possession of the natural supplement. Their reasoning? Kratom did not possess enough evidence to show it was safe four use.
Subsequently, it was put with other synthetic drugs like synthetic MDMA and synthetic marijuana hence labelling it as a Schedule I drug. Possession of Kratom currently is a misdemeanor and possession with an intent to sell is a felony. This fragmented legal status within the state is problematic as users could easily get into trouble because by simply going from a point to another with some kratom one might have forgotten exists could lead to a misdemeanor charge or worst of a felony conviction.
At the moment, San Diego County is also looking to follow in the path of the city of San Diego by banning Kratom. Considering the county’s status as the second most populated county consisting of 18 cities over 4,526 square miles of land, a ban could have immense implications for Kratom users in the state. The initial bill brought to the board of supervisors was to label Kratom plant a public health nuisance. Doing this would place an immediate ban on the sale, use, possession and distribution of the supplement
Thankfully, the county’s board of supervisors voted against plan to label it a health nuisance. Instead, they mandated county organizations to come up with solutions within 60 days. Thankfully, Kratom users within the county spoke up and gave glowing remarks about their Kratom experience. That managed to stave off the county’s hand and keep Kratom for the thousands of users within the county.

Is Kratom Legal Federally?
At the federal level, Kratom is currently unregulated leaving each state, city and town to decide its fate. This is what has led cities and states similar to be embroiled in situations similarly to what San Diego and California are currently going through. Founded 100 years after the signing of the Declaration of Independence, Colorado is known for its splendid natural settings including the ‘garden of the gods’, ‘Colorado national monument’ and so on. But how does the Centennial State feel about Kratom?

Denver’s ban on kratom came in 2017. Its Department of Public Health placed a restriction on the selling and possession of the supplement within its limits. This restriction allows the purchase of the kratom plant as long as all vendors place a label that states it is not fit for human consumption.
Kratom advocates in the form of the Libertarian Party of Colorado pushed back in 2018. They slated the government publicly for the restrictions placed on the supplement. And later that year, Castle Rock – a municipality within Denver temporarily restricted businesses from selling the products. According to the authorities, this ban was to last six months. It was in order to give the lawmakers time to decide if Kratom would remain legal in the municipality. In June 2019, the decision to make the supplement legal for adults over the age of 18 came about.

In 2019, the town of Parker moved to ban the sale of Kratom within its lines. According to the council, their decision came about in order to side with the FDA. Is Kratom Legal in Connecticut?
Kratom’s journey in Connecticut started off from a place of curiosity. As more users began to pop up within the cities and counties of Connecticut, there became need for a larger presence of Kratom within the state. As soon enough it began to show up in more mainstream wellness and convenience stores.
However, it has not always been smooth sailing for the natural supplement. In 2014, there were some cases in some other states that claimed Kratom was responsible for some adverse effects some patients were experiencing. Another setback occurred in 2018. A tainted batch of Kratom that held salmonella made the rounds resulting in 199 cases across 41 states.
This resulted in the state’s health department issuing a joint statement with the FDA’s public statement issues in 2017 warning about potential side effects of Kratom. The state also opened an independent investigation into Kratom and came up empty when they did not find any death that could be directly linked to Kratom. This researching coming up empty handed has caused Kratom to remain legal to sell and consume in Connecticut. There are no restrictions to purchase, distribute, possess and sell the supplement within Connecticut or any of its major cities or counties.

According to their research, they proposed classifying Kratom within the same group as decongestants.
