Kratom & The Law
Before Reviewing Kratom’s legal status at the state level, it is important we consider its status at the federal level. According to the government, Kratom is not illegal. They reversed the idea to list the supplement as a schedule I drug after only a few months.Â
Within the great state of Alabama, Kratom was legal until 2016. That’s when laws were passed which labeled it a Schedule I controlled substance, subsequently limiting its sale, distribution, and possession. Substances labeled as schedule I are items the government deems to have a high capacity for abuse with little to no accepted medical use.Â
Today, Kratom is illegal in all counties and major cities including Montgomery, Birmingham, Auburn, Mobile, and Huntsville. Users caught with the supplement are very likely to face criminal charges as well. There are also certain limitations that prevent online vendors from delivering Kratom to users who require it within the state.Â
Breaking Down Kratom’s Legal Status in Alabama
Like other substances, Kratom contains numerous compounds and alkaloids. In Kratom, two of its most prominent alkaloids are mitragynine and 7-hydroxymitragynine. These were deemed illegal by the state’s senate hereby making kratom illegal. According to the bill, those compounds were deemed as synthetic and harmful substances.Â
However, this designation is false because Kratom is a naturally occurring herb. This classification has led many to speculate that the reason for Kratom’s inclusion on this list Is the fact that it remains untested by the government.Â

Till date, there have been two petitions within Alabama. The petitions urge lawmakers to repeal their decision to place a ban on Kratom in 2016 and another calling for an appeal in 2017. Neither was successful and Kratom remains illegal till today.
What is The Kratom Consumer Protection Act
Designed by the American Kratom Association to regulate the fast-growing industry. The Kratom Consumer Protection Act has one key goal in mind – The stability and growth of the Kratom industry. As a fast-growing industry, an issue Kratom faces is, left unchecked there exists the possibility for fake and synthetic products.Â
The hope is, as a result of the protection act, numerous issues like age restrictions, labeling, testing, and compliance will come up for resolution. We are also hoping that Federal and statewide kratom bans will become a thing of the past. Then, all kratom fans could use and enjoy their favorite supplement without fear of government persecution.Â
